Effective date: TODO: EFFECTIVE DATE
These Terms of Use ("Terms") apply to ohvtrips.com and any related pages, emails, and tools (the "Site"). The Site is owned and operated by AJW Ventures LLC, a Colorado limited liability company ("OHVTrips," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. What OHVTrips is (and isn't)
OHVTrips is a free trip-planning tool for off-highway vehicle (OHV), side-by-side, dirt bike, 4x4, and snowmobile trips in Colorado. We collect trail, route, weather, permit, and listing information from public agencies, mapping providers, partners, and other sources, and we offer an AI trip guide.
OHVTrips is for planning only. We are not a land management agency, a guide service, or a tour operator. We don't organize, lead, or supervise trips.
2. Trail, legality, closure, and permit info: confirm before you ride
Trail status, seasonal closures, vehicle-class rules, permit requirements, fire restrictions, and road conditions change often, sometimes daily. Information on the Site may be out of date, incomplete, or wrong.
Before every trip, you are responsible for confirming with the official sources that a route is open and legal for your vehicle, including:
- U.S. Forest Service: the current Motor Vehicle Use Map (MVUM) for the ranger district, plus any closure orders or fire restrictions. Under federal rules, the MVUM controls whether a route is open to motor vehicles.
- Bureau of Land Management (BLM): the field office's travel-management maps, closures, and notices.
- Colorado Parks and Wildlife (CPW): OHV registration or permit (residents and non-residents) and snowmobile registration, as required.
- State, county, and local rules: including county rules on OHV use of county roads, private land boundaries, and any state land rules.
- Permits and passes: any required permit, reservation, or fee from the managing agency (for example, through Recreation.gov).
- Avalanche and weather: the Colorado Avalanche Information Center (CAIC) forecast and the National Weather Service for winter or high-alpine travel.
If the Site conflicts with an official agency source or a sign on the ground, the agency source and the sign win. Stay on routes that are legally open, respect closures, and don't trespass on private land.
3. Off-road riding is dangerous: you assume the risk
Off-road riding and backcountry travel carry inherent risks of serious injury, death, and property damage. These risks include, among others: rollovers and crashes; steep, narrow, washed-out, or exposed terrain; water crossings; mechanical failure; getting lost or stranded with no cell service; wildlife; other riders and vehicles; high altitude; lightning, sudden storms, extreme heat or cold; wildfire; rockfall; and, in winter or high terrain, avalanches, which can be fatal even on routes that look safe.
You choose your routes, your vehicle, your equipment, and your conditions. You are responsible for your own skills, training, safety gear (including avalanche rescue gear and training where relevant), vehicle condition, navigation, supplies, and the safety of your passengers and group. You voluntarily assume all of these risks. Nothing on the Site, including difficulty ratings, route estimates, or AI guide answers, is a promise that a route is safe for you.
4. AI trip guide
The Site includes an AI trip guide powered by a third-party AI model. AI answers are generated automatically and may be wrong, out of date, or made up, including about trail status, legality, distances, fuel, weather, and safety. Treat AI answers as a starting point only, and always confirm with official sources (Section 2). Don't enter sensitive personal information into the AI guide. See our Privacy Policy.
5. Third-party listings, bookings, affiliates, and ads
The Site links to and features third parties, such as rental companies, outfitters, lodging, campgrounds, dealers, and ads. Some are paid placements or affiliate links (see our Affiliate & Advertising Disclosure).
- We don't provide or control those businesses' products or services, and we don't guarantee their availability, prices, quality, safety, licensing, insurance, or conduct.
- Any booking, purchase, or rental is between you and the third party, under its terms. We are not a party to it. (Merch in our own shop is different: see Section 5A.)
- A "Featured" or "Sponsored" label means the business paid for placement. It is not an endorsement or a safety review.
- We aren't responsible for third-party websites or their content.
5A. Shop orders (merch)
This section applies if you buy merch (such as stickers or shirts) from our shop at ohvtrips.com/shop. [TO-DO for Adam and Iris: every bracket below needs a real value before the shop goes live. The shop page and checkout must show the no-cancellation and no-returns terms in plain words next to the Buy button (not only a link), and the buyer must tick or click to accept them before paying.]
- Who sells to you. AJW Ventures LLC (OHVTrips) is the seller. Items are made to order by our print partner, Printful, and shipped to you. Printful is our supplier, not the seller. Payment is handled by Stripe. We never see or store your full card number.
- Who can buy. You must be 18 or older and have a shipping address in the United States. We don't ship outside the United States.
- Prices. The price shown for an item is the price of the item. [Shipping is shown at checkout before you pay, at our actual shipping cost. TO-DO: if you charge a flat or handling fee above Printful's actual shipping cost, put the excess in the displayed item price. Colorado's total-price law, C.R.S. 6-1-737, excludes only taxes and shipping at actual cost.] Sales tax is calculated from your shipping address and shown before you pay. TODO: TO-DO for Nora/CPA: confirm tax handling for shipping and for any Colorado retail delivery fee.
- Made to order, and shipping time. Each item is printed after you order. We expect to ship within TODO: X business days, and delivery usually takes TODO: X more. If we don't state a time, we'll ship within 30 days of your order.
- No cancellations or changes. Because each item is made just for you, orders can't be canceled or changed once placed. Please check your items, sizes, and shipping address before you pay. This doesn't limit your rights under law. In particular, if we can't ship within the time stated above (or within 30 days if no time is stated), we'll email you with a revised shipping date and the choice to wait or cancel for a full refund, and we'll handle any later delay the same way. We'll send the refund to your card within 7 business days of the cancellation (your bank may take a few more days to show it). We can also cancel an order ourselves and refund you in full if we can't fill it.
- Returns and exchanges. Because every item is custom-printed for your order, we don't accept returns or exchanges for buyer's remorse, wrong size, or a change of mind. TODO: TO-DO for Adam: you may choose to offer more, but Printful doesn't refund buyer's remorse, so any extra return or exchange would be at your cost. Please check the size chart before you order.
- Problems we'll fix. If your item arrives misprinted, damaged, defective, or not the item you ordered, or never arrives, email us at hello@ohvtrips.com within 30 days after delivery (or within 30 days after the estimated delivery date if it never arrived). Include your order number and, if the item arrived, a photo. We'll replace it or refund you at no cost to you. [TO-DO for Iris: the 30 days matches Printful's claim window. Printful's returns policy: claims for misprinted, damaged, or defective items are due within 30 days after the product is received, and claims for items lost in transit within 30 days after the estimated delivery date. Keep this window no longer than Printful's.]
- Address mistakes. Please check your shipping address. If a package comes back because the address was wrong or incomplete, or because nobody picked it up, we can reship it, and you'd pay the shipping again.
- Colors and sizes. Printed colors can look a little different from your screen, and sizes can vary a little between production runs. That alone isn't a defect.
- Not affiliated. OHVTrips merch is not affiliated with, endorsed by, or sponsored by the U.S. Forest Service, Colorado Parks and Wildlife, or any vehicle maker. Trail names and road numbers appear only to name the places they refer to. Brand names that appear on the Site belong to their owners.
- Tips. Tips are voluntary payments to AJW Ventures LLC. They aren't charitable donations, aren't tax-deductible, and don't buy anything. They can be refunded only if the charge was a mistake or unauthorized.
- Your rights under law. Nothing in this section or in Sections 9 and 10 takes away any warranty or other right you have under law that can't be waived, including your rights with your card issuer.
6. Accounts and user content
You must be 18 or older to upload photos or place a shop order. Anyone may browse the Site, and people under 18 may use the trip planner with a parent's or guardian's permission. A contract with a minor can often be undone by the minor, which is why uploads and orders are limited to adults.
If you create an account or save itineraries, keep your login secure; you're responsible for activity under your account. Photo uploads are governed by our Photo Upload Terms, which are part of these Terms.
Corrections you send us
When you send a correction or suggestion (including through the "Suggest a correction" form), you give AJW Ventures LLC a free, permanent, worldwide, non-exclusive right to use, edit, and publish the information in it, and to combine it with other information on the Site, without crediting or paying you. Facts themselves aren't owned by anyone, so this mostly covers the way you wrote them. We review every correction before changing anything, and we may decide not to use it.
Don't send confidential information (for example, private business plans, trade secrets, or anything you aren't allowed to share). Anything you send is treated as non-confidential. If you say you're the owner or representative of a business, you're confirming that's true, and we may ask you to verify it before we make changes.
7. Rules of conduct
You agree not to:
- post or promote illegal riding, riding in closed or wilderness areas, off-route travel where it's prohibited, or trespass on private land;
- upload content you don't have rights to, or content that is unlawful, harassing, hateful, sexually explicit, or that invades someone's privacy;
- scrape, copy, or resell the Site's data or content in bulk, or use bots to access the Site, except standard search engine indexing;
- try to break, overload, reverse-engineer, or gain unauthorized access to the Site or its systems;
- misuse the AI guide, including trying to make it produce harmful or unlawful content, or using it to build a competing product;
- impersonate anyone or misrepresent an affiliation.
We may suspend or end your access, and remove content, if we believe you've broken these Terms.
8. Our content
The Site's design, text, original maps and route compilations, logos, merch designs, and the OHVTrips name belong to AJW Ventures LLC or our licensors. Public agency data and third-party map data stay subject to their own terms (see Data Sources & Attributions). You may use the Site for your own personal, non-commercial trip planning, including printing or saving your own itineraries.
9. DISCLAIMER OF WARRANTIES
THE SITE AND ALL CONTENT, DATA, MAPS, AI ANSWERS, AND LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, AJW VENTURES LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY TRAIL OR ROUTE IS OPEN, LEGAL, OR SAFE, OR THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.
10. RELEASE AND LIMITATION OF LIABILITY
YOU UNDERSTAND THAT THE SITE IS A FREE PLANNING TOOL, THAT USING IT IS VOLUNTARY, AND THAT OFF-ROAD RIDING IS A RECREATIONAL ACTIVITY, NOT AN ESSENTIAL SERVICE.
TO THE FULLEST EXTENT ALLOWED BY COLORADO LAW, YOU RELEASE AJW VENTURES LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND CONTRACTORS FROM ANY CLAIM FOR INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM YOUR USE OF THE SITE OR YOUR RELIANCE ON ITS INFORMATION, INCLUDING CLAIMS BASED ON OUR NEGLIGENCE. This release does not apply to our willful and wanton conduct, gross negligence, or anything else the law doesn't allow us to waive.
TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.
11. Indemnity
You agree to defend, indemnify, and hold harmless AJW Ventures LLC and its owners, members, employees, and contractors from any third-party claim, loss, or expense (including reasonable attorney fees) arising from (a) your riding or trips, (b) content you submit, (c) your breach of these Terms, or (d) your violation of any law or anyone's rights. This does not apply to the extent a claim is caused by our own willful and wanton conduct.
12. Governing law and venue
These Terms are governed by Colorado law, without regard to conflict-of-law rules. Any lawsuit about the Site or these Terms must be brought in the state courts located in Park County, Colorado, unless the law requires otherwise (for example, small-claims rules that require filing where a party lives), and you and we consent to those courts' jurisdiction.
13. Changes
We may update these Terms. We'll post the new version with a new effective date, and for significant changes we may also notify registered users or email subscribers. Continuing to use the Site after a change means you accept the updated Terms.
14. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part is enforced to the maximum extent allowed. Our failure to enforce a provision isn't a waiver. These Terms (including the shop terms in Section 5A), together with the Privacy Policy, Photo Upload Terms, and Affiliate & Advertising Disclosure, are the full agreement between you and us about the Site.
